منصة ريفا هي منصة إلكترونية انشأت من أجل الربط بين أصحاب المنتجات العقارية والعملاء الراغبين في الاستئجار عن طريق خدمة استأجر الآن وادفع لاحقاً.

وضعت هذه الاتفاقية لحماية وحفظ حقوق كل من (منصة ريفا) والعملاء الذين يستخدمون المنصة سواء بتسجيل أو من دون تسجيل وتعتبر هذه الشروط والأحكام ملزمة نظامياً من تاريخ تسجيلك في المنصة.

نحن نحتفظ بحقنا بإجراء تعديل أو تغيير على هذه السياسة، وسيتم إشعار المستخدمين بهذا التغيير أو التعديل وعليه يتعين عليك الاطلاع على هذه السياسة والإشعارات المرسلة دورياً، يعتبر استمرارك باستخدام المنصة بعد مرور 7 أيام من تاريخ التعديل بمثابة إقرار وموافقة على السياسات التي تم تعديلها والمطبقة وقت استخدامك للموقع. وتعتبر ريفا منصة مالية أنشأت لتقديم عدد من الخدمات والتي منها على سبيل المثال لا الحصر التالي:

• عرض وتسويق المنتجات العقارية.
• خدمة استأجر الآن وادفع لاحقًا.

استمرارك باستخدام الموقع بمثابة موافقة على السياسات المطبقة.

التعريفات:

مقدمي المنتجات: هم الشركات/ الأفراد المشتركين في المنصة وذلك لغرض عرض منتجاتهم العقارية.

يقصد بـ المستخدم/المستخدمين: هو الفرد أو المؤسسة أو الشركة الذي يستخدم أو يصل أو يزور الموقع ويستفيد من أي من الخدمات المتاحة في المنصة أو التطبيق أو يحصل على أي من المعلومات المنشورة فيها بشكل مباشر أو غير مباشر سواء كان ذلك بتسجيل أو بدون تسجيل.

يقصد بـ الموقع الالكتروني/المنصة: موقع www.refa.sa بالإضافة إلى أي أو كل مما يلي:

• تطبيق الهاتف الجوال الخاص بنا.
• صفحاتنا على منصات التواصل الاجتماعي.

الاستخدام: الاستفادة من أي خدمة من خدمات " ريفا "أو التسجيل أو التواجد على منصتها، يشمل التعريف جميع أزمنة الفعل.

الخدمة: عرض المنتجات العقارية في المنصة أو استئجار المنتجات العقارية بالدفع لاحقًا.

المحتوى: أي نصوص، أو رسوم جرافيك، أو صور أو رسومات أو أصوات أو فيديوهات أو برامج أو بيانات الموقع أو مخططات أو واجهات المستخدم أو تصميمات الشعارات أو صوتيات أو موسيقى أو أعمال فنية أو رموز خاصة بالحاسب الآلي أو أي أشكال أخرى من البيانات أو معلومات التواصل بدون استثناءات ويشمل ذلك على سبيل المثال لا الحصر تصميم وتركيب واختيار وتنسيق وعرض "الشكل والمظهر" وترتيب أي محتوى تم إتاحته عبر الموقع.

التزامات المستخدم:

• يجب أن يكون مستخدم المنصة كامل الأهلية وأن يكون عمره فوق ثمانية عشر عامًا، وأن يلتزم بالشروط والأحكام وجميع سياسات ريفا.
• ألا يكون مستخدم المنصة سبق إيقافه أو حظره أو تعليقه أو إلغاء أي حساب مستخدم له سابق.
• يتعهّد المستخدم بعدم استخدام منصة ريفا إلا بالطرق والأغراض المشروعة والمقبولة مع مراعاة الآداب العامة، وعدم مخالفته للأنظمة والقوانين المعمول بها بالمملكة العربية السعودية، أو الإضرار أو التعدي أو إيذاء الغير، وأنه سيمتنع عن أي فعل من شأنه أن يؤدي إلى الإضرار بعمل المنصة، وألا يقوم برفع أي مادة تحتوي على فيروسات أو ملفات أو برامج مصممة لاعتراض عمل البرمجيات أو القضاء عليها أو الحد من إمكانياتها، ويكون المستخدم مسؤولاً عن جميع الانتهاكات لأي حكم أو اتفاق قانوني - بما في ذلك هذه الشروط والأحكام عن قصد أو إهمال - والتعويض عنها.
• استخدام المنصة وفق الشروط والأحكام الواردة في هذه الوثيقة.
• يلتزم المستخدم بتسجيل بياناته ومعلوماته الصحيحة وتحديثها عند كل تغيير يطرأ عليها، وإلا سيتم النظر في البيانات والمعلومات المسجلة لدينا وتنفيذها وفقًا للقانون، ويجب أن يتحمل جميع العواقب أو الخسائر الناتجة عن عدم تحديثها، بما في ذلك العرقلة أو عدم القدرة أو الفشل في تسليم الطلب.
• أنك تقر وتتعهد أنك تمتلك حقوق الملكية الفكرية لجميع البيانات والمحتويات التي تقدمها لنا أو لديك إذن من مالك تلك الحقوق. وبمجرد تقديمك للبيانات فأنت تمنحنا ترخيصاً باستخدام تلك البيانات ونشرها وعرضها وتنزيلها وحفظها ونسخها والتعديل عليها، حسب سياسات الخصوصية المتبعة.
• يلتزم المستخدم بمراجعة هذه الشروط والأحكام وسياسة الخصوصية، وكذلك الإخطارات التي يتم إرسالها عن طريق المنصة ومن خلال وسائل الاتصال التي يقدمها لنا، ويكون أي إشعار أو تنبيه يرسل على المنصة منتج لآثاره ويكون بمثابة الإشعار الذي تم تسليمه للمستخدم.
• تسجيلك للحصول على حساب بالمنصة، أو عن طريق النقر لقبول شروط الخدمة على المنصة، يعتبر موافقة منك على هذه الاتفاقية وشروط الخدمات الأخرى الكترونياً، وتعد نافذة قانوناً في مواجهتك من تاريخ تسجيل حسابك أو من تاريخ القبول بشروط الخدمة. كما أن استخدامك للمنصة يعتبر موافقة صريحة منك على الشروط والأحكام والسياسات الأخرى كاملة، وتعد ملزماً قانونياً بها من تاريخ الاستخدام.
• يلتزم العميل بإرسال جميع المراسلات المتعلقة ببيانات الدفع أو الشروط والأحكام أو الشكاوى أو أي معلومات أخرى يتم تبادلها بين ريفا وبينك الكترونياً، ويعتبر عنوان البريد الإلكتروني الذي قدمته إلينا هو عنوان التواصل بينك وبين ريفا ولضمان التواصل معك إلكترونيًا فإنك توافق على أنه من مسؤولياتك إبلاغنا على الفور بأي تغيير في عنوان بريدك الإلكتروني أو رقم التواصل (الهاتف/الجوال) أو أي معلومات أخرى تقدمها لنا وقد يتم التواصل معك من حين لآخر لطلب تحديث لهذه المعلومات أو أي معلومات أخرى متعلقة بحسابك.
• يتعهد العميل بالتزامه بدفع أي مبلغ مستحق الدفع ما لم يتلقى اشعاراً كتابياً بخلاف ذلك. وفي تلك الحالة، يحق للعميل المطالبة بجميع الحقوق والتقديرات والمبالغ.

أحكام عامة للتسجيل:

• يجب تقديم المعلومات بشكل صحيح وكامل، قد نقوم بإغلاق حسابك الشخصي بشكل كامل ودون الرجوع إليك إذا تبين أنك قمت بإدخال معلومات غير صحيحة أو مضللة، أو قمت بانتحال اسم شخص آخر. كما أن جميع البيانات التي تقدم إلينا تخضع لسياسة الخصوصية المتبعة، لذا نحثكم على الاطلاع عليها وقراءتها.
• يحق لنا إغلاق حسابك في المنصة بشكل نهائي أو مؤقت ودون الرجوع إليك؛ إذا تبين لنا أنك قمت بمخالفة أحكام وشروط وسياسات الموقع ولم تمتثل لأحكامها أو لأي سبب آخر تراه المنصة.
• إن وصف المنتجات العقارية أو الخدمات العقارية وتصنيفه يكون من مقدمي تلك المنتجات أو الخدمات، ونحن لا نقوم بأي تصنيف للخدمات والمنتجات، لذا يجب عليك معرفة إن جميع المعلومات المذكورة هي من مقدم الخدمة، ونحن لا نتحمل أي مسؤولية في حال اختلاف الواقع عن المذكور.
• لا تتحمل المنصة أي تأخير أو أخطاء أو ضرر أو خسائر أو سوء الخدمة من مقدمي المنتجات العقارية.
• عليك معرفة أن الحساب الشخصي ملك خاص بك، لذلك ينبغي عليك عدم مشاركة الرقم السري أو بيانات الحساب مع الغير حتى لو طلب منك ذلك. كما أنك تقر وتوافق بأنك تتحمل مسؤولية أي إجراء يقوم به أي شخص باستخدام اسمك أو حسابك أو كلمة مرورك، يجب عليك اتخاذ جميع الخطوات والوسائل اللازمة لضمان الحفاظ على سرية هذه البيانات.

سياسة الأمن السيبراني:

• يلتزم مستخدمي المنصة بتعزيز الأمن السيبراني والالتزام بما تصدره الجهات المختصة في هذا الشأن، ونلتزم بسرعة التعامل مع أي حادث أو اختراق للمنصة بما يكفل عودتها إلى عملها المعتاد في أقرب وقت ممكن دون الإخلال بالأمن السيبراني للمنصة.
• نلتزم بإخطار الوزارة في حال تعرّض المنصة للاختراق، والمستخدمين المتأثرين به مع توضيح آثاره والتدابير المتخذة لمعالجته، خلال (3) أيام من تاريخ علم (ريفا) بالاختراق.

المسؤولية:

• نحن لا نقدم أي تعهدات أو ضمانات، صراحةً أو ضمناً، بشأن الموقع الإلكتروني أو محتواه. ومع ذلك، فإننا نلتزم بحماية بيانات العميل ومنها (الاسم -العنوان - الهوية - أرقام التواصل - أرقام الرخص) وأي بيانات شخصية أخرى وتأمينها ضد أي تهديدات محتملة، بما في ذلك الفيروسات الإلكترونية والهجمات السيبرانية.
• يقر مقدم المنتجات العقارية على أنه يتحمل كامل المسؤولية تجاه المستخدم في أي من المنتجات التي يقدمها من خلال المنصة للمستخدمين، ويقر ويتعهد بأن المنصة لا تتحمل أي مسؤولية تجاه استخدامه للمنصة وعلاقته مع المستخدم وما يقدمه له من خلال المنصة.
• إن المنصة غير مسؤولة عن نتائج التقييم والتعليقات الواردة في تعليقات المستخدمين فيه، وعن الخسائر التي قد تحدث نتيجة لها، كما أنها غير مسؤولة عن التوصيات التي تظهر لأي منتج أو خدمة للمستخدم، وذلك لأن هذه النتائج والتوصيات هي نتيجة لبيانات إحصائية مقدرة أو آلية وفقاً للمعلومات أو الآراء أو البيانات التي تم جمعها من المستخدمين.

Terms & Conditions

REFA platform is an electronic platform created to connect real estate product owners and customers wishing to rent through the Rent Now and Pay Later service.

This agreement was established to protect and preserve the rights of both (REFA Platform) and customers who use the platform, whether registered or without registration. These terms and conditions are considered legally binding from the date of your registration on the platform.

We reserve the right to make an amendment or change to this policy, and users will be notified of this change or amendment. Accordingly, you must review this policy, and the notices sent periodically. Your continued use of the platform after 7 days from the date of amendment is considered an acknowledgment and approval of the policies that were modified and applied at the time of your use of the site. REFA is a Fintech platform created to provide several services, including but not limited to the following:

• Presentation and marketing of real estate products.
• Rent now and pay later service.

Your continued use of the site constitutes acceptance of the applicable policies.

Definitions:

Product Providers: Companies/individuals participating in the platform for the purpose of displaying their real estate products.

User(s): The individual, institution, or company who uses, accesses, or visits the site and benefits from any of the services available on the platform or application or obtains any of the information published in it directly or indirectly, whether with or without registration.

The website/platform: The website www.refa.sa in addition to any or all the following:

• Our mobile application.
• Our pages on social media platforms.

Use: Benefiting from any of REFA's services, registering, or being present on its platform. The definition includes all verb tenses.

Service: Displaying real estate products on the platform or renting real estate products and paying later.

Content: Any texts, graphics, pictures, drawings, sounds, videos, programs, site data, charts, user interfaces, logo designs, audio, music, artwork, computer codes, or any other forms of data or information without exception. This includes, but is not limited to, the design, installation, selection, coordination, display, "look and feel" and arrangement of any content made available through the Site.

User Obligations:

• The platform user must be fully qualified, over eighteen years of age, and adheres to the terms and conditions and all REFA policies.
• The platform user must not have previously been suspended, blocked, suspended, or any previous user account cancelled.
• The user undertakes not to use the REFA platform except in legitimate and acceptable ways and purposes, considering public morals, and not to violate the regulations and laws of the Kingdom of Saudi Arabia, or to harm, infringe or harm others, and that he will refrain from any action that would lead to harming the work of the platform. The user must not upload any material that contains viruses, files, or programs designed to intercept, eliminate, or limit the work of the software. The user will be responsible for all violations of any legal provision or agreement - including these terms and conditions intentionally or negligently - and compensate for them.
• Use the platform in accordance with the terms and conditions contained in this document.
• The user is obligated to register his correct data and information and update them upon every change that occurs to them. Otherwise, the data and information registered with us will be considered and implemented in accordance with the law, and he/she must bear all the consequences or losses resulting from not updating them, including obstruction, inability, or failure to deliver the order.
• You acknowledge and undertake that you own the intellectual property rights to all data and content that you provide to us, or you have permission from the owner of those rights. Once you provide the data, you grant us a license to use, publish, display, download, save, copy and modify that data, in accordance with applicable privacy policies.
• The user is obligated to review these terms and conditions and the privacy policy, as well as the notifications that are sent through the platform and through the means of communication that he/she provides to us. Any notification or alert sent on the platform will have its effects and will be considered the notification that was delivered to the user.
• By registering for an account on the platform, or by clicking to accept the terms of service on the platform, you are deemed to have agreed to this agreement and the terms of other services electronically, and they are legally effective against you from the date of registering your account or from the date of acceptance of the terms of service. Your use of the platform constitutes your express acceptance of the full terms, conditions and other policies, and you are legally bound by them from the date of use.
• The customer is obligated to send all correspondence related to payment data, terms and conditions, complaints, or any other information exchanged between REFA and you electronically. The e-mail address that you provided to us is considered the communication address between you and REFA, and to ensure communication with you electronically, you agree that it is your responsibility to inform us immediately with any change in your email address or contact number (phone/mobile) or any other information you provide to us, and we may contact you from time to time to request an update to this information or any other information related to your account.
• The customer undertakes his obligation to pay any amount due unless he receives written notice otherwise. In that case, the customer has the right to claim all rights, assessments and amounts.

General Provisions for Registration:

• The information must be provided correctly and completely. We may close your personal account completely and without consulting you if it turns out that you have entered incorrect or misleading information, or that you have impersonated the name of another person. All data provided to us is subject to the applicable privacy policy, so we encourage you to view and read it.
• We have the right to close your account on the platform permanently or temporarily without consulting you if we find out that you have violated the terms, conditions and policies of the site and have not complied with their provisions or for any other reason the platform deems appropriate.
• The description and classification of real estate products or real estate services comes from the providers of those products or services, and we do not undertake any classification of services and products, so you must know that all the information mentioned is from the service provider, and we do not bear any responsibility if the reality differs from what is mentioned.
• The platform does not bear any delay, errors, damage, losses, or poor service from providers of real estate products.
• You should know that the personal account is your property, so you should not share the password or account data with others, even if they ask you to do so. You also acknowledge and agree that you bear responsibility for any action taken by any person using your name, account or password, and you must take all necessary steps and means to ensure that this data is maintained confidentially.

Cybersecurity Policy:

• Platform users are committed to strengthening cybersecurity and adhering to what is issued by the competent authorities in this regard. We are committed to quickly dealing with any incident or hacking of the platform in a way that ensures its return to its usual work as soon as possible without disrupting the cybersecurity of the platform.
• We are committed to notifying SAMA in the event that the platform is exposed to a hack, and the users affected by it, explaining its effects and the measures taken to address it, within (3) days from the date (REFA) becomes aware of the hack.

Responsibility:

• We make no representations or warranties, express or implied, regarding the website or its content. However, we are committed to protecting customer data, including (name - address - identity - contact numbers - license numbers) and any other personal data and securing it against any potential threats, including electronic viruses and cyber-attacks.
• The provider of real estate products acknowledges that he bears full responsibility towards the user in any of the products he provides through the platform to users and acknowledges and undertakes that the platform does not bear any responsibility regarding his use of the platform, his relationship with the user, and what is provided to him through the platform.
• The platform is not responsible for the results of the evaluation and comments contained in the users' comments therein, and for the losses that may occur as a result of them, nor is it responsible for the recommendations that appear for any product or service to the user, because these results and recommendations are the result of statistical data estimated or automated according to information, opinions or data collected from users.
